1. Our Mission

TravitudeBNB's mission is to create a world where anyone can belong anywhere. Our platform connects guests with hosts, enabling unique travel experiences across Romania and beyond. These Terms set out your rights and responsibilities when using our services.

2. Using TravitudeBNB

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, you may not use our services. We may update these Terms from time to time; continued use after changes means you accept the updated Terms.

3. Eligibility and Account Registration

You must be at least 18 years old to create an account. By registering, you confirm that all information you provide is accurate and that you will keep it up to date. You are responsible for keeping your account credentials secure and for all activity under your account.

4. Content and Listings

Hosts are responsible for ensuring their listings are accurate, lawful, and comply with all applicable regulations. Listing content must not be misleading, defamatory, or infringe on any third-party rights. We reserve the right to remove any listing that violates these Terms.

5. Bookings and Payments

When a guest books a listing, a legally binding agreement is formed between the guest and the host. Payment is processed through our platform. Service fees may apply to both hosts and guests. All prices are inclusive of applicable taxes unless stated otherwise.

6. Cancellations and Refunds

Cancellation and refund terms depend on the policy set by the host for each listing. We offer several cancellation policy options. Guests should review the cancellation policy before booking. We may also have extenuating circumstances policies that override standard cancellation terms in exceptional situations.

7. Host Obligations

Hosts must provide accurate listing information, honor confirmed bookings, maintain a safe and clean space, comply with all local laws and regulations (including licensing requirements), and treat guests with respect and without discrimination.

8. Guest Obligations

Guests must treat the host's property with care, respect house rules, communicate honestly, and comply with all applicable laws during their stay. Guests are responsible for any damages caused during their stay.

9. Reviews

After a completed stay, both guests and hosts may leave reviews. Reviews must be honest, respectful, and relate to the actual experience. We do not edit reviews but reserve the right to remove reviews that violate our content standards.

10. Prohibited Conduct

You may not:

• Use the platform for any unlawful purpose
• Post false, misleading, or fraudulent content
• Harass, threaten, or discriminate against other users
• Circumvent our payment system or booking process
• Scrape, crawl, or otherwise extract data from our platform
• Attempt to gain unauthorized access to our systems

11. Privacy and Data

Your use of our platform is subject to our Privacy Policy, which describes how we collect, use, and share your personal information. By using our services, you consent to our data practices as described in that policy.

12. Intellectual Property

All content on our platform — including logos, designs, text, and software — is owned by or licensed to us. You may not copy, reproduce, or distribute any platform content without our written permission. You grant us a non-exclusive license to use content you submit to the platform for the purpose of providing our services.

13. Disclaimers

Our platform is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any listing or user content. We are not responsible for the actions or omissions of hosts or guests.

14. Limitation of Liability

To the maximum extent permitted by law, our liability to you for any claims arising from your use of the platform is limited to the amounts you paid through the platform in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your infringement of any third-party rights.

16. Governing Law

These Terms are governed by the laws of Romania. Any disputes arising from these Terms or your use of our platform shall be subject to the exclusive jurisdiction of the courts of Romania, unless the arbitration clause in Section 17 applies.

17. Dispute Resolution and Arbitration

Please read this section carefully. You and TravitudeBNB agree to resolve any disputes through binding individual arbitration, rather than in court. This means you waive the right to participate in a class action lawsuit or class-wide arbitration.

This arbitration agreement does not apply to claims that qualify for small claims court, or to claims of intellectual property infringement.

18. General

These Terms, together with our Privacy Policy and other policies incorporated by reference, constitute the entire agreement between you and us regarding our platform. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision does not constitute a waiver.
